Heres the situation. I have been working for a small accounting firm since July 2001. It is just my boss (president and CPA) and myself that work here. Up until June of this year everything has been pretty good. Although I don't get health insurance I make a decent wage and when I have needed it my boss will advance me a pay check or two to get me by. Since I have been hired my vacation and personal days have not gone up, like most people's do. I am given a week paid vacation and a week paid personal days. Most people would have gotten more added to that the longer they have been at the job, but I haven't complained. I get my regular, yearly raises and have been satisfied. my boss's mother is elderly and have several major strokes a few years back so she needs inhouse care. When my boss goes out of town for a seminar, vacation, or convention I have been the one to go to the house in the morning and provide her with breakfast, including running the office while he is gone.

Anyway, I basically keep everything running smoothly while he is away. I open and close the office on a daily basis and overall handle a vast majority of the business related problems. when I became pregnant with my first child this past June and told him about it he has been more than difficult to work with since. The problem being that I am due March 1st. which is right in the middle of tax season ( busiest time of the year) I offered to work from home, but he refuses. He refuses to give me paid maternity leave and says he is just going to lay me off until April 15th. or whenever I can come back to work. He has no set maternity leave policy and I think he is just pissed off that I am due when he needs me here the most. What do you think, should I let him lay me off and collect unemployment and then come back in April, or should I collect the unemployment until I can find another job. Possibly someone who will appreicate me and not punish me for wanting a family????

Since it is a 2 person office e is not required to follow the federal family leave act. It sounds as if he is taking advantage of you. I would find another job after you give birth which covers health insurance and other regular benifits.
Let him find another babysitter for his mother.
P.S. Federal law does not require you to get additional vacation (or any vacation days actually) after 1 yr 3ys or any yrs.

Let him lay you off, that may allow you to collect unemployment. Otherwise what are your options. You take any time you are entitled to (vacation etc) and then he fires you because you don't show up or you quit.
When you are ready to return back to work, if the job is still available, the consider whether you want it. However, I would assume that it won't be, that he will have replaced you. You may find he is willing to let you bring your child to work with you and make other accomidations once you are actually gone, or you may not.
I wouldn't plan on going back. I would just work until you wish to be on leave and then see where the situation is and go from there.

check your state laws concerning maternity leave and pay, each state is different. Most companies don't pay maternity leave. I was on leave for 12 wks and thankfully had short term disability insurance which paid parts of my wages for about 6 wks.
but check you state laws just to be sure

in the adventure that your boss is a jerk and you think of he's going to furnish you a no longer ordinary time approximately it, basically get a notice out of your physician or midwife asserting that that's no longer possibly secure for you or your toddler's well being to proceed working up till your due date. He won't be able to whinge approximately that. in case you do no longer suggestions telling him a litle white lie, once you supply him the notice, tell him youre VERY sorry--which you had to proceed working up till your due date, yet your physician mentioned in any different case because of the fact of your blood tension or swelling or something, and that he says that's the consequences of your activity (being on your ft all day, bending over, and so on.)

As it is. If you are paid a check that has taxes taken out of it, you are entitiled to maternity leave. Its federally mandated. You must get ATLEAST 6 weeks paid leave. And you get up to three months unpaid leave, during which you can apply for disability.
You need to contact you local labor department and find out what you can do to get what you're entitled to.
