There are jurisdictions where it would be considered slander by deed or unjust vexation. These are minor crimes but still penalized with jail time.

A few years ago...New Jersey passed a law making it illegal for drivers of motor vehicles to give the finger. There was just too much road rage.

It has gotten to the point that "the finger" was known as "The Jersey Wave'.

It depends or wither or not you are saluting the man or the uniform.. Two civilians can do it with no problem. If it breaks into a brawl, then the offense could be inciting a riot, public menace, public disturbance. If it is to a police officer, it could be one of the worse decisions you ever made.
