ok My last scheduled day was last night. this morn when I got off they told me I was on call. well they called about a half hour ago and i didn't answer. If I don't go to work tonite, will I lose my holiday pay.

ok I obviously didn't work the hours I am off of work but willi get my holiday pay for christmas eve christmas day and new years eve because the rule is you have to work your last scheduled day b4 the holiday and the 1st day after it right??

While it is true that your last "scheduled day" was last night, when you were informed by your supervisor that you were "on call", your "schedule" was changed.

Since you didn't (or couldn't) object, the supervisor was led to believe that you had accepted the assignment.

Since you failed to respond to the "call", you did not work your last "scheduled" day and therefore forfeited holiday pay, at least for the 2 Christmas holidays (if you are not scheduled to work before the New Year holidays, then you will forfeit that benefit as well).

Now, as a defense you can always look to "past practice". What has the company done in the past under similar circumstances?

Has the company scheduled "on call" personnel during the holiday in the past? If "on call" personnel failed to respond over a holiday, did they lose holiday pay? Were they "disciplined" for their failure to respond?

Were you being paid a premium (addition to wages) for being "on call"? Is there a premium for responding to a "call"? If scheduled? If not?

it is illegial to with hold money from someone - if you have worked the hours
