The rule is the rule for "age of consent" in your state. Remember too that there are often multiple levels. In some states anyone having sexual relations with anyone on the other side of the adult age line, be it 18 or 21, is guilty of statutory rape is the issue is pressed. Then there is usually a prepubescent line where adolescents can copulate with adolescents (but not adults) all they want, but not with prepubescents, a line that also varies. In my state a boy of 17 was convicted of statutory rape for copulating with a 14 year old girl. The issue is not hetero/homo it is simply age of consent that makes the copulation truly legitimate to the law.
