Why does he like breaking and entering in the first place? and what if someone left the fire going? Wouldn't he die?

Um, I don't believe in Santa, which is what the skepticism is for.

Santa is magical. He makes sure the fire is out. And, if he doesn't use the chimmney he uses his magic mittens.

If the fire is going santa would see smoke coming from the chimney so he would use the door or window instead. He could leave your presents outside where theives could easily steal your presents in the middle of the night. He likes using the chimney because it is the quickest way for him to enter the house since he lands on the roof.

Well, not all Santas use the chimney. There's one, for instance, that leaves presents in the children's shoes, which they place outside their door on December 6th, I believe. There are others who simply leave it on the doorstep. And then there's Tim Allen who has an inflammable suit and can transform other heating systems into fireplaces in the case of a home not having one. :]
Besides, you don't see the Tooth Fairy being charged with breaking and entering or even attempted kidnapping, seeing as he/she goes straight to the kid's room and it would look awfully suspicious if someone caught them there.

Santa doesn't have a key to all the houses, so it's easier to go down the chimney. He probably has a fire proof suit.

Well, he uses the chimney because "Chopper" the rottweiler gets annoyed when he uses the dogie door.
As for the fire, if you has spent the past 11 months freezing your backside off at the North Pole you would probably welcome a nice fire to warm you up.

He goes down the chimney because he's too fat to get through the key hole and so that the reindeer don't mess up the yard when they land.
