My buddy has a Suspended DL, but in another state. He is going out of town and may need to rent a car, and asked me this. I dont know and answers has always been very helpful before. So when you go to rent a car, are they able to pull up your records from the DMV? He still has possession of his DL Card, its just officially suspended.

I don't believe that they have that ability or would want to pay for that ability.

But now consider this. He rents the car and doesn't tell them about his suspension. He damages the car or worse yet causes and accident. That will be run with the insurance company who will check his DMV record. He lied on the application, he is liable for any and all damages to the rental car and any other property. That could get really really exspensive..
Now consider that an injured party is told that the rental insurance is not covering the claim due to your buddy driving under a suspension without the owners (rental agency) knowledge. Can we say law suit.

And that is not even considering the Johnny Law aspect of the police finding out during the accident investigation.

So, long story short, it's not illegal until your caught.. maybe ?
