Background Info- two parents in the process of divorce because one was unfaithful. This same parent has now stop all financial help leaving the other parent (with 3 children) with only $10). Is this legal?

Of cousre not. Many times people want to punish the children because they are angry with the spouse. Courts dont take that well generally and will make things equitable for the childrens' sake.

No it's not legal. When the divorce goes to court the judge will make that parent pay child support and probably back child support and interest. Unfortunately, there is nothing you can do right now except to go to family court and get an emergency child support hearing. I am not sure what state you're in but check your state government office on line to see how you (sorry, your parent) can do this. Best of luck.

It's not if the $10 was in a JOINT checking account. The other parent needs to contact an attorney now, and get a child support order and if applicable, an alimony order in place. MOST definitely child support. The attorney also needs to take care of the banking problems.

No, this is not legal. A lawyer needs to be contacted asap and if they're still married, then the parent that left with all of the money can actually be charged with child negligence.

Unfortunately, yes it is legal until the court orders this parent to make payments. It isn't right that this parent would abandon thier children without means to support them. This parent maybe pursuaded by pressure from family and friends to do the right thing.

Unless child support and other monetary support has been ordered, it is legal. The parent doesn't have any legal obligation. Is it right? No! But if there's no court order, than it's legal.

If child support and other monetary support *has* been ordered, then it's not legal. An attorney needs to be contacted ASAP.

The parent who has the kids needs to go to court and get a temporary child support order, along with a temporary custody order.

It depends on where you are. In the United States child support for offspring who are minors is mandatory under the law and may not be legally withheld pursuant to prosecution, fines, and imprisonment.

NO it is not legal, but don't worry I am sure that your Mom is taking care of this and knows the steps to take. Don't take this on yourself and don't put yourself in the middle of it. Your parents will work this threw, even the worst weather ends in sunshine.

It is legal for them to stop the finanacial help. It is their money at the end and they have the right to choose what they want to do with it.
