I can only tell you how it used to be-I'm not current. It used to be a complicated formula-but-condensed- if you made more than the minimum your total income must remain above what you would make at minimum with time and a half over 40. I assume you're not union or you would not be asking-they're different.
EEOC will be in the front of the phone book and they can answer this question without having to worry about whether it's accurate. You want to be sure before you confront your boss.

A person can not work overtime with out being paid for overtime. It is against the law.
