the company will investigate it they will have to come up with some conclusive evidence - you will be invited to a meeting you will be able to take an independent person in - go through this procedure if you didn't do they cannot prove you did. you will then be reinstated

Suspension is not a punsihment (and I assume it si opn full pay) it siply allows an opportunity for the employer to investigate the case thoroughly whilst protecting bith you and the company.
Unfortunatly, however, and you are not going to like this, the CAB are correct, if you are dismissed following this, you need 1 years service to bring a claim for unfair dismissal at a tribunal.
With regards to the burden of proof, unfortunally the principles of Civil law apply to employennt dismissals whereby the employer only has to prove 'on thye basis of probability' that an employee did something. ie is it more likely or less likley that they did it.
in your case, the only thing i can recommend is to provide as much details to your employer about what you did, any witnesses you have, give them areas they may have failed to investigate. you do not say what evidence they have on yiu I can not give you any specifics. All i can say is do you best and defend youself vigerously. A trade union rep or work colleage should be able to accomapny you to give you support and put your case accross and your employer should have provided you in advance all the evidence they are going to use at the eharing in order for you to prepare your 'defence' if they fail to do this you are within your rights to ask for the hearing to be postponed or adjourned until these are forthcoming.

What the cab has told you is not quite true, you have been suspended but you will still have a hearing, you have been suspended from work (this should be paid) whilst an investigation is carried out. If you want help you can mail me at

have they got proof have been accused before with contracts of employment the could terminate you without a good reason within either 12 months or 2 years how strong is their case against you are you the only one in the frame find out the times when this occured and your movements youve seen all the films about detection well that is what they all go off is evidence if you were in the claer fight like hell if you are not sure leave ie resign but remember leave with respect you know if they cannot proove it try to negotiate a refererance that you left of your own free will it seem that if they dont trust you someone else could be doing it and youve dropped unlucky check all the facts first,

I feel for u but don't give up yet....suspended you say ...you should not loose out financially then ...you have got a leg to stand on in fact u have two....use them.....take a friend to your place of employment and ask them to put in writing any evidence they have to substantiate their unfounded accusation and as you haven't done it all evidence they have will and can be pulled apart by a solicitor....don't let them bully you or let them get away with this...fight it you have got rights you are innocent until proved guilty and they can't prove what you haven't done how about your trade union? a solicitor may fight on no win no pay basis.....in any case this is not just about a false accusation its about your good name ...and what is right.....good luck x x x

they're right, i was sacked about a year ago from my job purely cos my manager was jealous that i got better with everybody than she did - anyway was there for 9 months and although was unfairly dismissed - had no leg to stand on at all!!!
But strongly believe everything happens for a reason and although you may feel devastated now - something bigger and better will come along!!
What you need to ask yourself is, do i wanna work somewhere where everyone thinks I'm a thief anyway???

Check out the employment laws in most states as well as the employee handbook. Most of the time there is some sort of process that you can go through to clear your name. Find out what exactly are the allegations are against you. Make them pull security footage, if applicable.

you could sue them for slander. but thaty isnt going to help you get job back. only thing you can do is insist they call police and have you cleared, but even then they can still get rid of you with little comeback as you been there less than a year
