to fix it. after that it ran okay. but now that same oil problem is back and the car has oil all over the fly wheels and etc. also i let my 16 yr old son drive the car to school 1 day and it happen to be a day that it was k9 day. the police did a drug sniff on the car and found drug residue. they did not lock him up,because the knew he did not do drugs and the knew me. what is my legal recourse in this as to having the dealer let me trade this car back in? any advice.

How long was the warranty, if any? Did you have the car checked out by your own mechanic prior to purchase? You said you had a problem and the dealer repaired it. Now after 3 months, you are complaining about the problem again. You can ask the dealer to see if the shop will stand behind the previous repair, but if the car has been out of warranty for some time, you may have to pay for the repair yourself.

A warranty has specific time and mileage limitations. If you have exceeded those limits, you have to pay for the repairs yourself.

The situation with drug residue in the vehicle (again after three months) is something you will have to deal with yourself. You bought a used car. The dealer did not have control of the vehicle since it was new, they either took it in trade, or they bought it from the owner or at auction.. There is no way you can expect the dealer to be responsible for a drug dog finding something (and you do not say if they found any drugs, just that the dog alerted on the car).

You might want to talk to the dealer about trading it in, but expect to lose money on the deal. Check to see if the previous repair is related to the current oil leak, and see if the shop will stand behind their repair, if it is defective. Have the car detailed and steam cleaned, and trade or keep it!

if it truly is the same problem with the vehicle as before, the dealership should fix the problem. if the problem is a valve or something that routinely needs to be fixed and replaced, then it is not their responsibility. I would contact the same individuals you worked with last time, because hopefully they remember your situation.

as for the drug residue...that is going to fall on your shoulders, because after three months, regardless of what you say you and your son's reputations are, it would still be your problem. take the car to have it detailed.

if you just want to get rid of the car, ask the dealership to work with you on trading the car in and getting another vehicle. at this point, you cannot just return the vehicle for full price but usually the dealership will try to work out some kind of deal to make all parties involved happy.

The dealer is still responsible for the repair. The drugs are your problem to handle.
