I was always under the impression that the U S Congress made that declaration, not President Roosevelt.

Roosevelt asked the Congress for a Declaration of War, which it gave him.

"In most democratic nations, a Declaration of War customarily has to be passed by the legislature. In the United States there is no format required for declaration(s) of war. The term "Declaration of War" is not, in fact, mentioned by the US Constitution. Instead the Constitution says "Congress shall have the power to ... declare War, ..." without defining the form such declarations will take. Therefore, many have argued congressionally passed authorizations to use military force are "Declarations of War." That concept has never been tested in the US Court system. Some, such as Congressman Ron Paul, argue that an explicit Declaration of War is, in fact, a Constitutional requirement."

GERMANY declared war on the United States FIRST.

Germany transmitted the declaration of war on 11 Dec 1941... Congress then declared:

"Whereas the Government of Germany has formally declared war against the government and the people of the United States of America... the state of war between the United States and the Government of Germany which has thus been thrust upon the United States is hereby formally declared"

So you're theory that President Roosevelt declared war is baseless unless you have a source. President Roosevelt sent a FORMAL letter requesting that Congress match Germany's declaration... and Congress passed that resolution with a unanimous vote in BOTH houses.

Neither FDR or Congress declared war on Germany. Germany (an ally of Japan declared war on the United States Three days after the Attack on Pearl Harbor.

So there would be no legality involved. War was declared and America responded in kind.

The united states didn't declare war on Germany they declared war on us. Thus a declaration wasn't necessary though I believe congress passed a declaration of war later in response to Germany.

Not sure what that means. Congress declared war on Germany on 12/11/1941. Rosevelt asked congress to do it. And Germany had declared war on the US earlier in the day before we reciprocated.

?!? The US declared war on Japan for the attack on Pearl Harbor--with the approval of Congress. Germany declared war on the United States even though their treaty with Japan did not require them to go to war with Japan's enemies. Some people call it Hitler's biggest mistake.

You got some bad information there. This is the perfect example of how we LEGALLY declare war, not illegally. It is in texts and is cited as the ideal way a declaration of war in the US occurs.

both of your positions are WRONG. the us declared war on japan and never declared war on germany or italy. germany and italy declared war on the united states december 10, 1945. roosevelt did not even declare war on japan, but asked that since the attack on december 7, that a state of war had existed. it was the congress who made it a formal state of war on december 8, after roosevelt's speech. roosevet did not declare war, only asked for a declaration of it.

I don't know when it began, but the President has been starting $hit for a very long time. This power, unrecognized as illegal, has been occurring for at least 50 years, and maybe more. I have the documents, just not at hand.

Anyway, according to our Constitution, ONLY Congress can declare war. President Bush is, at the very least, a criminal.

They bombed Pearl Harbour. FDR was agreat leader. I wish we had him now. He would put Bush in his place. God Bless America.
