Hi there. My wife was served at her work to appear in court with Ford credit. We voluntarily returned the car when we couldn't make the payments. Should we bother showing up in court? What's the worse they can do? And, if the car is in her maiden name, can they garnish my wages? Thanks for any input.

Wow. Thanks for the input so far. We plan to show up. I didn't know there was a bench warrant issued for a civil suit, I just figured it means you automatically lose. I guess I was asking will it matter if we're there or not. Thanks again for the answers so far!

Never miss a court date. If you miss you will lose. It is a default. Go to court talk to the judge and let he/she know what the circumstances were causing the repossession. 9 times out of 10 the judge Will work a reasonable plan out.
They can garnish depending on the state laws in your state.

Your wife needs to show up in court. Not showing would be contempt and she would automatically loose and in theory she could go to jail. It's not likely she would go to jail, it's just a theoretical possibility. The most likely case is that the court will give Ford a judgment and Ford will garnish her wages.

You and your wife might get lucky, the attorney for Ford might oversleep or get a flat tire and then not show in court. Then Ford would not get a judgment against her.

you don't show for court & a bench warrant will be issued for non-appearance and your wages will be garnished to pay off your debt at the rate of 25% of your gross

Go to court, from what I hear, someone like Ford doesn't show up and it is a non-issue.

Time to settle these out for pennies on the dollar. Repos usually can go as low as 35 cents on the dollar.
