I was charged with two counts ofpossession of a controlled substance with intent to deliver and endangering a child, but never arrested. I was spending the night with my mother when her house was raided. I was the only one not arrested, but just found out I was indicted on those charges.

in short, yes. A written accusation charging that an individual named therein has committed an act or omitted to do something that is punishable by law. The purpose of an indictment is to inform an accused individual of the charge against him or her so that the person will be able to prepare a defense.

Normally this procedure would be when a Federal Crime was involved. They would hold a grand jury indictment to determine if there was enough evidence to proceed to trial. If there is they would send you a supoena to appear in court or a warrant for your arrest would be issued.

You need to contact a lawyer and find out your rights and plan your defense. You should have done that already so if you haven't do it asap

yes, you can, you don't have to be "arrested" at the scene, and often people go though a grand jury hearing after the DA presents the evidence to them.

But an arrest is merley the police charging you, but the DA can decide to also charge you.

so you will be served, and if you were indicted most likely a warrant is issued for your arrest

Absolutely you can be charged. Constructive possession is very real and can land you in prison. Get attorney ASAP

yes, if no one owned up to the drugs, then everyone in the house gets charged. the judge, prosecutors and police will eventually find out who the drugs belong to and your case could possible be dropped

according to everyone else's response, I would guess yes. Never been arrested for drug charges myself, but I would think that being as it wasnt your house you should be able to get out of it because you didnt know they were there.
