Actually in Canada, the offence of break and enter is defined as
Break, enter and commit and indictable offence

All three elements must be present.
So if Santa is only leaving presents, then he is not committing an indictable offence (like Break Enter and Theft). The only charge that may apply is unlawfully in a dwelling house or perhaps trespassing. He might argue that there is implied consent of the homeowner because cookies and mild were left out for him.

Probably not, because everyone likes gifts. However, what if someone left their fireplace on and Santa came down and got a little burnt?

Nope, he would have special permission! Besides he's leaving stuff not taking anything---well the cookies and milk but remember they leave them for him, so again it's not breaking & entering, because of them leaving cookies & milk is their way of giving him permisson to enter. Happy Holidays!

No. He doesn't break and enter. He comes down the chimney. So he'd just be arrested for trespassing. He'd probably get off for being mentally unstable.
