"liable" is what is called a "loaded" word. Yes, they are responsible for their actions. But there are limitations and exceptions in every event by any person.

I am only answering this because we have active duty folks reading this stuff.

I assume we are talking a combat vet going back redeployed?

The situation, sucks.

PTSD is a big issue: the Veterans Adm is overloaded, the military, well they have no central policy or plan.

Mental health issues are real career busters in most cases,
sometimes one can change their MOS or such. Hey, therapy helps, some medications.

PTSD does not even equate "insanity" but does seem to suggest one's actions may be "not typical".

One has to depend upon their fellow soldiers, a medic who is also a friend, etc.

PTSD is not "all bad" but that is enough for another Ph.D.
program to explain.

The VA has some great counselors, social workers and psychologists: I was one. They unlike many of the military "shrinks" have seen combat. That is why they became therapists?

So, if someone "freaks out' does not report, etc, well they be in deep "dodo". If the VA does not get big funding, well, it will be as bad as it was for my fellow Vietnam Vets.

Oh, career soldiers seem to have a better support system, does not mean they do not have issues, but unlike Vietnam we are not dumping 80% of our Afgan-Iraq vets on the street after the combat tours. Most of the guys in Vietnam were 2 and 3 year service obligation. They just went from Army to civilian in a few days.

One is responsible for one's actions, any good soldier seeks peer support, advise then medical help.

Yes you are liable. Get a grip!! PTSD is not a new condition, just an excuse. Most of the knuckle heads claiming to have PTSD are support personnel that never even heard a shot being fired. I've been in 6 armed conflictes. Two with the 3rd Ranger Bat. and 4 with the 82nd and have never met a real combatant claim to be suffering from PTSD. Grab your nuts, and march on.

If you have been diagnosed with PTSD I doubt you would be eligible for active duty. However, this would have to be documented by medical personnel. It's not just your word.
