I wont join the bandwagon of people lecturing you for not having insurance. If you are in an accident you will get a very hefty ticket, maybe get your license suspended, and it will be very hard for you to get (affordable) insurance for the next 3-5 years.
If the other person has insurance and they were at fault, you can file a claim against their insurance co and they will pay... assuming the accident was not your fault. In NY they have something called comparative negligence which basically says that if both cars were moving... both are somewhat at fault. So it may be 80% their fault and 20% your fault... meaning the insurance co will pay 80% of your damages. Just because you didint have insurance it doesnt make you at fault for the accident so the people telling you that are wrong. You are in a bunch of trouble for not having insurance but that has nothing to do with who is at fault for the accident.
Good luck... and buy insurance! If it was the same situation and it was your fault, and someone was hurt.... you would be royally screwed right now.

You not having insurance doesn't mean you won't get your car fixed.
In this case, since it was their fault, the repair is covered by THEIR insurance, if they have it.
If they DON'T have insurance and if you don't, then you lose your car, pure and simple.
Worse....if you still owe money on the car....you both lose your car and you still have to pay off the loan.
I know it can be tough to afford, but if you can't afford insurance, then you probably shouldn't be driving. What would have happened if it would have been your fault and if you would have hurt somebody badly. Even if you didn't have insurance, they'd still sue you and you would have to pay them back by giving them all your money and selling off your stuff to pay back the judgment.

Be glad they didn't take you to jail. Most states require minimum of PL/PD coverage. That's Property Loss & Property Damage, which will pay you neither, it's for the people YOU incur loss or damage to.
So you can try to sue them for damage, but you really have screwed youself. They will probably sue you, even if it them who were at fault, as you state.

I don't know about where you live, but it is illegal to drive a car and not own insurance here in California.
If the other driver is at fault and is proven such, their insurance should cover the damages, however, you will, also, have to deal any legal consequences for driving without insurance.

The other driver is at fault, therefore, their insurance should cover the accident. Any damages you have and any medical bills for you and any passengers you have should be taken care of by the other company. If you were at fault, it would be another story entirely.
Now you should have learned your lesson, so GO BUY SOME INSURANCE!

You deserve everything you get for not having insurance. Someone hit me without insurance and it cost me time and money. If you don't have insurance...don't drive.
If the person that hit you is at fault then he has to pay for your damages. If it is your fault...your screwed.

First of all you can be cited for driving without any insurance which may lead to a suspended license. You may get some money for your car since it was not your fault but the insurance company will try to fight the fact that you carried no insurance.
