Im not too sure if you get pulled over, but if you had an accident you surely would and you would be up for everthing. When you rent a car, it is assumed the person who is applying will be the only one driving it, unless it states differently on the contract. I live in Australia and if you get pulled over for whatever reason, it is not compulsory that you have to produce your registration papers...you only have to produce your licence, unless the Policeman thinks your vehicle may be unregistered, so if he only views your licence then he wouldnt know the vehicle was a rental. If the policeman does expect to see your registration and it turns out you are driving a rental car in your mothers name, then he may contact the rental company and let them know someone is driving their car illegally. If the contract was taken out in your mothers name, then driving the vehicle would be considered illegal. If it was me, I wouldnt risk it. If your mother wants you to drive it, then tell her to put your name on the rental contract as well to save any kind of problems arising. If you were caught driving her rental car, then she would be up for all the added costs involved, eg. if you are under 21, etc. If you had an accident, well, I would hate to be in your shoes. Its not worth it...do it the right way and get her to put your name on the contract. It will probably cost her more, but hey, it would cost her a hell of a lot more if she doesnt. If you plan to drive it without her permission and you get caught, she would probably have to have you charged with theft so as she will not be liable for all the expenses.
Think very carefully of the consequences first.

Depends on what you got pulled over for. Serious moving violation, and you aren't listed as a driver on the rent a car, you go to jail and the car gets towed. Something minor, and you are an approved driver, perhaps a warning, perhaps a ticket.

If your name is listed on the rental car agreement as an alternate driver, you won't be in any trouble with the rental agency. If you get a ticket while in a rental, you will still get points on your license, just as you would if you were in your own car. Violations follow the driver, insurance follows the car.

if you did something ilegal to get pulled over yes. but what do you think high school kids get prom cars from. their parents rent them. as long as you have proper information and a license, you're straight. but if you get pulled over, you're in trouble no matter whose car it is.

I don't think that you can unless she didn't give you permission. Don't quote me on it. I do know that when you rent a car they take down your D.L. number and they have you as the primary driver. As long as you have insurance I think that you will be okay.

she should have your name as second driver, she won't get in trouble from the police but could cause trouble with the rental company
