There are government liquidations in which the US allows certain military vehicles to be sold at auctions. But, never, absolutely never will you ever be able to locate a military tank for civilian sector sales. When a tank is no longer modern, they are either sold to other militaries for cheaper deals or they are completely scrapped. Yes, I won't deny you the fact there are many people who wish they had tanks to go around and blast the heck out of people or buildings, but, this is exactly why civilians won't ever be allowed to have battle tanks. Plus, there are just too many nut cases out in society that would get their hands on these weapons for the wrong purposes.

Decomissioned vehicles can be purchased by civilians in contrast to what J.F. said. From Hummers to tanks to half-tracks and troop carriers, these can be purchased if you have the resources and inclination to go through the proper channels. A man in Colorado who goes by the name Dragon Man has a private museum of functioning military apparatus including an M47 tank. He is specially licensed by the BATF to maintain such equipment...

Yes, you can legally own a tank, but they are not street legal in most states and communities unless they are fully rubber tracked (no steel cleats). You're better off going with a WW2 military armored car or half-track (rubber track), but they are kinda spendy to restore and maintain. Here in Minnesota armored cars and half-tracks are street legal with collector plates, just have to keep' em off the freeways (too slow).

Dude! It's my dream to walk in to an Army Surplus store and find one for 50 bucks that was put there accidentally due to bureaucratic cockup. No one would ever cut me off in traffic again.

Army surplus store? Who knows what they have in stock! Seriuoulsly though, unless you're a dicator in an African country or some such, you might have a bit of a problem getting yourself one.
