i'm a nanny and when i had a major tooth infection (no insurance) i stupidly stole painkillers and penicillin from my employer. got in a situation where my car was searched and the bottles were found. i have been charged with criminal possession of a controlled substance and given a court date. was told that i'll probably get probation. however, can my former employer charge me with anything such as theft or child endangerment?

Why didn't you just go to the county health clinic (about $20/visit), get a prescription for penicillin, and have it filled at Wal-Mart ($4/prescription for generic)?

Yes, your employer could charge you with theft and child endangerment, but under the circumstances, you'll likely still just get probation.

Your former employer can file a theft charge against you. The law, DA, can charge you with theft, posession of controlled substance and child endangerment. There are free clinics everywhere, better to go to one if you have no insurance than to steal from anyone. If you get probation, it will be much better than you deserve.

Apparently he is named "Zombie" for a reason. The thing you left out of your question was "What type of painkillers" were they. If you were charged with CPCS I bet they were "Controlled" as in Narcotic. Additional charges could include Possession of Stolen Property....and you probably left out the reason why you were pulled over in the first place...like erratic driving and under the influence (of the painkiller narcotics)...Your employer will probably let the Police and courts do their job and he will do his. As Donald Trump would say "YOUR FIRED"

Firstly, it's ridiculous that you were charged with possession of a "controlled substance." The only thing you did wrong was steal. What you consume of your own accord is your business, and yours alone.

That said, your employer can almost definitely sue you if you were on the job at the time. Not a smart move on you part, for sure. Hopefully things will be resolved.

Theft, yes. Child endangerment, no. Although they may fire you based on your conviction. You will get probation and maybe some community service. Not much.
