SO i'm driving down Phoenix's wonderful highway system when a lady in a full size truck starts bouncing off cars like a ping pong ball and slams into me making me spin like a top across 3 lanes of traffic. She hits me and another driver and we go to the right shoulder of the highway while she continues to spin into the middle cables on the left. Me and the other driver assume she did something stupid or blew a tire to just fly out of control like that. When the cop comes over to me he asks what happened and when I only have about a 15 second story ending in "I was talking to my passenger, he said watch out and before I could turn my head we were spinning across the highway" the cop says "Well, thats not what the driver of the truck said, she had a much more elaborate story... " and goes on to tell the cop about how we were following her for miles, brake checked her and all this other stuff. So my question is; Will the cop most likely see through this BS story or will I have to pay big?

My insurance company's been involved since the time of the accident. It looks like the other driver isn't going to be able to pull off the story, considering she hit the first car in the far right lane and then over-corrected and hit me in the far left lane. Even if her story was true at all, it doesn't excuse her causing the accident. It is up to each driver to be a safe distance from the car in front of them. So it looks like her insurance company is picking up the tab for everything. Now my question is... Does she get more punishment for lying to a police officer? I can't believe someone can just say whatever they want to without any punishment. I think police offericers see enough of this to smell BS when they see it.

You should involve your insurance company into it ASAP. Also, do you have witnesses? It looks like it's going to be pretty messy. Insurance company will rather believe your side of the story beacuse they don't want to pay for this accident. They are your best friend now. Also, possibly a lawyer, if the claims are significant. If you're low income I suggest you consult a community lawyer rather than no lawyer. They usually give one free consultation and they will advise you how to better protect yourself in this case.

There needs to be proof in one direction or the other, the thing that would help you the most is some witnesses, even the passenger of your car can be a witness, if the insurance companies can't come to some kind of agreement on who is at fault, then you will both be responsible for your own vehicles.

if your story is accurate then get together with the other drivers. You should have collected everybodies information. If you didn't you may be out of luck. There is a reason you should collect everything for yourself. You can involove your insurance company but then it is pretty much you vs them and they have a police report on their side.
You also said the magic words "I was talking to my passanger" to the cop. Now they can prove you didn't have your full attention on the road.
You can contact your ins. company and explain to them. This is your best route, they don't want to have to pay for all of that, which could be the outcome if you don't act fast.
