Hello Everyone,

I have one issue related to H1B visa stamp on my passport.

In my indian passport, I have a visa stamp valid through Nov 2007. That stamp is from my previous employer-A. My new employer-B has transferred my visa with them and I started working with them. I have all the required papers related to my visa transfer to my new employer.

Now my question is, do i need to stamp on my passport for my new employer if i leave USA and re-enter it after 2 week's vacation? Remember, I still have valid h1-b stamp on my passport but it is from my old employer and currently i am working with my new employer.

Please advice.

I guess in any case you need to re-apply when you change your employer...

Unfortunately, you'll have to get a new visa stamp. Some other visa stamps don't require this, all they care about is the validity date. However, H-1B are very specific about who the employer is. If you cannot make a visa interview appointment during your two week vacation, you may have to stay in the US. If not, you may have a very long wait at the port of entry when you come back!

Yes, you will need to have a new H1B stamped on your passport.

Note that when you transfer your visa, the old control number on your visa is voided and a new one is issued. So if you try to enter on an old H1B, the scan will come up as voided.

No, you cannot just enter USA without having your visa stamp in passport. The visa approval papers are no good, if you dont have a visa stamp.

Are you serious......You have no reason for entering the US and US officials probably pressured your work sponsor to cancel your visa or face fines.You cannot return to the US if your visa is cancelled.The only true way to find out is to go to the US embassy and find out anything else could result in your spending money unnecessarily like on a ticket and then be denied entry or not even allowed on the plane if your details don't check out. You can't get what you want with regard to US immigration law if there is no basis for your entry considering you freely admitted that you never even worked.You can be sure any new US visa you apply for now will be under a lot of scrutiny since they have your details.

No you don't need a new stamp, just carry your approval paperwork with you from your new employer.

New employer needs to sponsor you.
