About a year ago I got pulled over for a DUI & I didn't do any of the test or submit to a breathalizer. Now I have been convicted of a Reckless Opp, served my time gone through treatment, go to at leats 3 AA's a week and have been sober since. Now here's the question, this isn't my first, its my second. I recieved one about 4 years ago and have been on probation since. Now I'm just about to get my lisence back and start moving forward with my life. When I went to get reinstated they told me that I have a warrent out for my arrest for violating my probation. They said that refusing to blow was a violation of my probation. I need advice - should I get a lawyer, will I see jail time, will they resuspend my lisence, are there fines. Please only serious awnsers. This is my first probation violation.

You should contact both your old probation officer and a lawyer (legal aid or public defender if you can't afford one). You should have been notified by someone about the violation before a warrant was issued, to give you an opportunity to appear in Court and address the violation.

it could be, yet this can land up being a discretion difficulty on the area of the Probation Officer. he will have questions for particular, one issue of probation is be regulation abiding and a rushing value ticket skill he wasn't. in the adventure that your buddy avoids the PO he may be violated. If he talks to his PO about it the worst i believe if receives, if he has been sparkling otherwise, is a sturdy chewing out.

If you refused to blow on the second dui and you were already on probation, then yes absolutely you have violated.Lawyer or no lawyer.I would let the judge know how well you've done in rehab and that relapse is part of recovery

Were you on probation when you denied the breathalizer? If so, the answer is yes.
