Question regarding childminder?
my childminder has said she wants to take next week off as 1 of her holidays my problem is she wants full pay which i dont think she should get ,usually childminders charge when parents take holidays but not when childminder takes holiday what should i do?

ps.
no contract has been signed, i dont mind her taking the holiday but i dont think i should pay her

she is not live in childminder she has my kids for 15 hours a week, i take 4 weeks holiday a year and i pay her full pay during my hols

No contract - no payment BUT do you really need her? what would happen if she left? Is it easy to get another child minder, if so let her go (ie sack her) if not then you will need to come to some sort of compromise.
Technically she is 'self-employeed' and therefore is not entitled to holiday pay.

To be honest you should have a contract, if she is a registered childminder she legally has to have a contract and you should have been told the condtions of the contract, if she is not registered i would find one who is as its the only way you know your kids are ok as theres police checks ect have been done. Regarding holidays its completley up to the childminder though i woulnt ask to be paid for holidays tha i take as its unfair.

I am a childminder and i do know others who get paid for there own holidays, but they have it written into the contract.

I would discuss it with her and draw up a contract whilst your there.

also final note she should give you at least a months notice for ho;idays, so i do think she is being very unfair.

if she is a live-in and you are the only means of income, i would think it is fair to pay her. think of it this way...if you work full time and have earned a week of vacation from your employer, they pay you vacation time for that week you take because you have put enough time in with the company to earn it...correct? yes!

paying your "childminder" (dislike this reference but w/e) is paying for the vacation time she has earned working for you. you are the company and she is the employee. where do you think the daycares get the money to pay the employee's for their vacation and sick days....you the parent! so don't think you are not paying for their sick days and vacation pay...cause you are. you the parent pay them to watch your children, and in turn you make them (the daycare) money to pay their employees.

just pay her....its Christmas, she may be depending on that money to buy gifts for her family. and in the future get a contract so you both know what to expect around the holidays and vacation time

No way. My daughters nursery shuts for 4 weeks a year and they dont charge, they only charge half fees for when the child is on holiday too

A contract of employment does not have to be written to be valid. She is entitled to holidays, and normal protection, but so are you. She is entitled to prorata holiday pay,(depending on jurisdiction), but you can decide on when she has to take it. Regularise her situation as soon as possible, and then get rid of her...you are heading for trouble!

Not fair tell her your going to have to pay someone else to look after the kids while she's off. Or if really need her services half pay as a retainer.

I do daycare and I would never make my parents pay on the days I take off!!! I would not pay her, that is ridiculous. Tell her your point or just try to find a different daycare provider. She must be desperate for money or something. Hope it works out for you!!

depends on how generous you are to your childminder. if its not in your spirit to give for the holidays then just tell her that you are not paying for her vacation only yours

if i am not childminding , i do not get paid , what arrangement's were made when you decided to take her on ,none , then she is taking the week off at her own expense, tell her if she work's she will get paid otherwise no . make sure you make proper arrangement's for the new year.

i am a childminder and you do have to pay for your holidays but not hers.. who is she trying to kid..... and you should get at the very least two weeks notice...
