You fill out the paperwork, pay your fines, cross your fingers and wait anywhere from 6 months to a year. It shouldn't take YEARS if you're married to a U.S. citizen. THe only thing that takes years is the citizenship. But he can still be legal. He might have the two things mixed up. Most likely he is legal now, with some kind of green card or paperwork, he's just not a citizen.
The only difference is as a citizen you can vote and you don't have to notify the government when you move.

A person who is in the US illegally cannot get their residence from marrying a US citizen unless he or she came to the US legally in the first place. If your friend came to the US with a visa, and is married to a citizen, and that marriage is a valid one (not a marriage just to get his papers), he can apply for his green card. Go to www.uscis.gov for the forms or talk to a lawyer.

Bottom line, he should leave the country, as he is here illegally. I'm sure there are are plenty of "nice" folks who are here illegally, but our immigration legislation has been put in place many good reasons. Abide by the laws of our nation, come here legally, or get out.

I can make a list of people who have been waiting to get in and reunite with their loved ones but are doing it the honest way, but will have to wait longer because people like your buddy cutting in line and abusing the system with a loophole. I'm sure that marriage will last 50 years, too.

I would tell him the best thing to do is get a lawyer. They can see what he needs to do. I feel sorry for your buddy cause there are people who deserve to be a citizen. Good Luck to your friend.

He needs to go back to his country of origin (if possible) or perhaps Mexico or Canada, and apply for a visa from there.

Check with an immigration lawyer. Sometimes one can find an immigation lawyer in their own ethnic community who will assist for free or for a reasonable fee.

Trying to file for a visa here, will either get him deported, put in jail, or both.

He'd have to leave U.S. before becoming legal and coming back.
Immigration lawyers are the best way to go for him.
