Absolutely not! A penalty notice or fine is no less valid if the officer was not wearing a hat when they issued it. (And off duty and plains clothes officers can issue penalties and fines that are equally valid - and guess what? No hats!) This is one of those urban myths that people who "know their rights" like to spread.

The only issue regarding an officer not wearing a cap or hat is that they *may* receive internal fines (about $50) if they are filmed /interviewed by the media when not wearing one. But even then it's a discretionary /common sense issue - otherwise every crim would be trying to knock their hats off!!

Lets get to the really matter of the question. You are looking for any excuse to get out of the ticket, any technicality that might service your interest. Let's go to the extreme to make a point. Someone shoots you in your sorry a** and a Police Officer catches him but his hat is not on so the perp gets off......Dah, the answer to your question is Pay the ticket and shutup.

no. its an urban myth that they cant charge you if they dont have their hat on. Yes, it is part of the uniform and they may get into trouble internally, but that does not invalidate a charge or fine.
