My fiance is trying to become part of his son's life. He's not on the boy's birth certificate, and the mother isn't letting him see his son, so he wants to go to court to establish paternity. He WANTS to pay child support, so she is obligated to give him parenting time. Where should he start? He's willing to pay for the paternity test, but paying for a private lawyer isn't going to be possible. What are the steps involved when a father is the one seeking to establish paternity?

Is the mother receiving any afdc benefits like food stamps, he can go to the Department of child and welfare and let them know he is the father and he is willing to take care of his responsibilities, and they will start the paper work. If she does't receive any benefits he can go to the county procusors office and state he is the father and wants to care for his son, and they will start the paper work from there. If a person believes that he is the father of a child he shouldn't be paying money to the child's mother so that he can see the baby. He should be paying it so that these funds will help take care of it. Paying child support doesn't give a person the legal right to see any child. If your fiance wants to be part of the child's life he needs to contact the local Friend of the Court office in your area. They will set up testing and also a hearing to set up visitation with the child. If the test comes back negative the court will pay for the test but if it comes up positive then your fiance will be billed for the amount due afterward. A visitation schedule will be set up until age 18 unless the mother of the child wants to fight this. It would be hard for her to win a case against the father unless she has proof that he would not be a fit parent. Lawyers don't need to be involved unless the battle between the two of them gets ugly.

He needs to get the Court to make her take a paternity test to establish paternity, then once that is done work out child support and visitation. However, he should ask the court that he not be made to pay child support in the arrears because it is the mother who would not let him establish paternity sooner.

first are you in the uk or else where? as i know some what about scottish law but neway you should go to citazens advice beauru and ask them , they will be able to give you personal and legal advice as to how to tackle you problem and wont charge you to see them
