Have you notified the police? Make sure that the landlord has your complaints *in writing* as proof of grounds for eviction.
We had the Redneck Neighbors from Hell living below us (the bass problem isn't much better when it's coming from the bottom up) and dealt with them for like three years till we finally bought a house.

I have had upstairs neighbors like that. That must be difficult. The only thing you can do is to move. You should, however, be allowed to leave your lease early if the noise is so bad and the landlord refuses to evict them. I don't know if you can for certain, but that is probably you best option to check out it sounds like. I'm sure he won't put up a fight if you leave before your lease is up. Next time get an upstairs apartment, downstairs ones seem to be worse for noise. You already tried asking them to turn it down, right? And they didn't? So you know they are just jerks and there is nothing you can do about changing them.

I am living with this very same problem right now. I have a family of nine living above me. They run through the house, stomping and screaming. Playing music until all hours of the night. Doing laundry until 5 in the morning. So every once in a while I give them a taste of their own medicine. I play my music, pound on the ceiling, flush the toilet when I hear them in the shower. Nothing really works, they are still as loud as ever, but it makes me feel a little better. Jerks!

Have you mentioned the problem to your neighbor? Could he maybe be hard of hearing, so he has to turn up the volume? Could the thumps perhaps be weightlifting equipment? I'm just trying to think positively here. You surely have a right to peace in your own home, but I'm sure you wouldn't want your neighbor evicted if there's a less drastic solution that will satisfy everyone. Keep pressing the landlord, and keep him informed of whatever you decide to do. Best of luck!

You would need to call the police to enforce the noise ordinance. I had a neighbor upstairs with a horribly loud alarm clock. She set it to go off at 5 am and then she would keep hitting the snooze button until about 8 o'clock. This was a mind boggling problem for me. She sounds like your neighbor, walks like a heifer, and drops pianos. Call the police. You have rights too!! Best of luck to you!!

Oh my gosh! Trust me I feel your pain - I just moved from some apartments where my upstairs neighbor had a DRUM SET! I think there are few things as irritating as unwelcome noise. I complained to my landlord as well and nothing ever came of it...you might just take them their lease and point out the part that says 'this kind of noise can cause you to be evicted' and tell them to honor it or to let you out of your lease. It's worth a shot - good luck!

Complaints to landlord that wont work.
I live in apartment too... my above also a @### people..
The couples used to fight every week and their children seems like never sleep at night.
What can i do is whenever i meet up them, i will ask, "Hi, how are you lately, do you on your speaker very loud? I always heard someone screaming like coming from TV? Is it from TV?"
Normally they will give you a stuck answer, but at least they will quite for sometime.
For your case you can try the same way, remember dont purposely look for them. Do when just bump up, you can ask like this "Hem... Do you like to listen Rock, i always heard that. Sometimes when i sleeping also i can heard in dream too..haha(laugh)"...

I would contact a fair-housing type of attorney. I would also make record of dates, times, etc just to prepared. You don't want to be on the offensive, and it could make you look like that, so be careful. An attorney will help you know your rights, and how they apply in this situation. Good luck!

Move if you can..you will spend a lot of timetrying to get those people to respect your wishes..obviosly they never learned how to respect others by now ....so..tell your landlord you want out of your lease.it is a health issue to live with that kind of stress on a daily basis.he should be dealing with it .You never know what they will do next once they find out you are complaining about them...get out..........

If it keeps up call the law and file a complaint against them and maybe that will make them realize they are making a disturbance or they are real jerks and dont care who they make mad
