A friend wants me to keep his identity secret. He was involved in a car accident this weekend. with an 18 year old kid. He tried to get info out of the kid but had to call his dad. His dad in return told him he shouldve filed a report there and then, when it happened. He didnt elaborate whether he was insured or not.
He took pics of his car and was lucky to take pics of the other car's damaged front. Since it happened in a shopping center he got 2 local cops to go and get as much info out of the kid as they could.
The kid's dad is being bullheaded about doing anything.
Does my friend have a chance, with all that he has on the driver, the info, the photos, etc, to sue??

Of course one can sue over vehicle damage resulting from an accident (done all the time). However, your friend needs to stop playing lawyer by trying to handling this himself (contacting the father and so on).

Instead, if your friend has full coverage insurance, he should contact his insurance company immediately and let them do their jobs. This includes a proper investigation involving evidence, police reports, witness statements, proper damage estimates, and so on. After an investigation in your friend's favor (in other words, truly the boy's fault), they will contact the boy's insurance company and handle any legal issues involved.

If your friend does not have full coverage insurance, he should contact a lawyer as soon as possible (any delay could work against your friend). This lawyer will advise your friend on the best course of action, and will conduct the necessary investigation (which will also protect your friend in case the other party attempts to blame your friend for the accident - not at all uncommon).

As for your friend's chances in court, that is utterly impossible to say given the many variables. However, the right actions now (as described above) can greatly improve your friend's chances.

Let your friend put it in his insurance claim. The insurance company will pay your friend then go after the person who caused the damages for the money.
If you friend sue then he has to get estimates and take the other driver and his father to small claims court. Yes he has a chance the small claims court are filled with things such as this.

Should have called the police immediately! But if you have witness or pictures of the vehicles at the scene, you have a chance.

yes, he can be sued. the guy suing may not win but your friend will be out attorney fees. maybe it wont come to that. sounds like your friend should win.
