No and no you do not automatically become a legal resident either. BTW INS no longer exists. Now they have USCIS (United States Citizenship and Immigration Service) under the Dept of Homeland Security. Like stated earlier people who marry an American citizen will first have to go through an interview and will likely get a conditional green card. If their investigation does not find anything suspicious later on their status will be changed to a permanent resident status. However if it is discovered an immigration fraud was commited it is a federal crime and the illegal will be deported and the U.S. citizen may face a prison term and/or fines.

Marrying a US citizen does NOT automatically make you a US citizen, nor does it automatically make you a Permanent Resident of the US.

In order to live permanently in the US, even if married to a US citizen, you must still apply for an immigrant visa that allows you to become a Permanent Resident and then eventually allows you to apply for US citizenship.

Being married to a US citizen does not even guarantee you an immigrant visa, there is still the possiblity that an immigrant visa can be denied the spouse of a US citizen if you do not meet all the requirements.

Not automatically. He has to apply for a permanent resident (Green Card) spouse visa. At the interview he will be grilled about his marriage and he has to produce proof of its genuineness. He might get a conditional GC for 2 years. Before expiry of this period, he has to re-apply, and prove that the marriage wasnt one of convenience. If he satisfies the Immigration Officer, he will get a GC. He can apply for citizenship after 5 years of stay in US. However, if a child is born to the couple in the US, the child gets US citizenship at birth.

He becomes a resident first ,but only after the INS investigate if the marriage was of true love.

the foreigner gets the right to stay in america....i think thats it...they still need to apply for citizenship/
