The ring should go back to the fiance, and he should have the right to choose to do with it what he wants. It was an engagement ring and the wedding did not happen she died. Give him the option of doing what he wants with the ring. He may want to keep it for his own sentimental reasons. God bless****

Tough one. Etiquette says an engagement ring is a conditional gift, and should be returned to the man unless the ring was already in her family. Conversely, the wedding was not broken off due to a change of heart. I don't think either parties should argue over this item. Because it (i assume) recently came into the grandmother's acquisition, it does not hold any sentimental value to the daughter. Also, it almost certainly holds sentimental value to the fiance. In addition, because an engagement ring is a conditional gift, the lady did not technically own it yet, so that is another reason why it should go to the fiance. Legally, the daughter will probably get it, but if she is compassionate she will offer or give it to the fiance.

Legally - an engagement ring is a conditional gift - which means it only belongs to her if the conditions of the gift (meaning the marriage) are met. If she died before being married, legally the ring still belongs to the fiance because the conditions of the engagement were not met.
Of course, the fiance may want to pass it to the daughter, or he may want to keep it as a personal momento of the loved one he lost. Either way - the decision, legally speaking, is his to make:)

The fiance. See, an engagement ring is a contingent gift, in promise of a marriage. It only becomes hers once the wedding takes place. If the marriage never happens, then the ring reverts back to the owner, which is the fiance.

I think it should go back to the fiance. BUT it would probably go to the daughter. The daughter should give it to her mom's fiance. I just think that would be the right thing to do. BUT the fiance might not even want it.

It might legally be the property of the daughter, but that would be a pretty small person to keep it rather than giving it back to the fiance.

I say the fiance. It is then his choose whether the daughter should have it.
