My vehicle was towed and I called the towing company to see if could pick it up. It was 1am when I called and the employee was quite rude. I'm afraid I pissed him off enough that I think he might damage my car and steal items within it. My whole life is in that car, I stored all of my christmas presents for my family in there so that they wouldn't find them. It's so unfortunate to realize that they're missing when I pick up my car.

In the state of California, what should I do if find my car is damaged and see that there are missing items?

Do towing companies have the right to hold your car? I'm not from the area in which it was towed which is in Sacramento. I came from San Jose which it 2 hours away to visit a friend and I need my car to drive back asap.

why did you leave all of your worldly possessions in a car? that was a bad idea.

Go to the police station and file a report. Begin to gather all information in a file. Receipts for the gifts you purchased, witnessed that saw the gifts in the car. Approach the owner of the towing company with copies of these receipts and your witness/witnesses, and the copy of the police report. Move quickly and hopefully they will respond and release at least your gifts right away. If the gifts are no longer there, then tell them you will return in the morning and expect the gifts to be returned to you. No matter if they are wrapped or not. Tell the owner this won't fly. Tell them you're going to the Better Business Bureau and you will definitely take him to small claims court.
Stand your ground and be firm. Good luck to you! By the way, I also store my family's Christmas and other gifts in my car's trunk. Because of your question, I will no longer do this. Oh, and also check with your car and home owner's insurance company to see if your policy covers this sort of thing.

If the car is damaged you may have a civil suit against the tow company. I'd just ask them to pay for any damage first.

If items are stolen from the car, report it to the police.

Not a Quick solution but You can take them to small claims court later on. Make sure You keep records.
Not from California but Here they can hold Your car till You pay all expenses.
The saying goes they are the second most hated people, lawyers are the first,

Call the police while you are still on the towing company's property and file a stolen property report before you ever leave their property.
