You need to check the law. Go to an attorney. In the U.S. estate law is regulated by each individual state. Each state has laws that divide property among family members according to the law if no will is available. I know several states will give one third to the wife and two thirds to the children.
An attorney could tell you the law of asset titling. In the U.S. jointly owned assets generally go to the joint owner.

A) Italy is perhaps only one Country where married partners both share goods gained during marriage and receive goods after partner death.

1) Wife or Husband is heir as children and are entitled to receive an assets share, but they are entitled to use house for lifetime (value to be subtracted from his/her inherited share).

2) Under Italian law you can not exclude wife/husband or children from you last will

3) If you leaves no will a husband/wife receive:
2/3 share, if parents or other relatives (within some limits),but no children
1/2 share, if there is only one child
1/3 if there, if there are more than one child

B) each child has same rights under Italian inheritance law with two exceptions only:
1.incestuous children are entitled to only a time-life cash grant (same value as their share)
2. a foreign and ancient law regulates about agricultural estate, but in a germanspeaking province only, Alto adige/Sudtyrol: according an old provision backdating to Austrian Empress Marie-Therese, agricultural estates go to firstborn child (this rule is named "maso chiuso")
