After reading your question, I'd have to say it's more likely that you failed the written test than that you are too old.
There are many jobs you can get with 20 years in the military. Perhaps local law enforcement instead? My best friend's husband joined a local police force and moved up very rapidly thanks in part to his experience in the Marine Corps.

I think it is the same set of age criterion used to join the US Military.
Try County, or City Law Enforcement....they would love to have you.

i agree with you... perhaps approach this from the $$$ side, there is a lot of $ invested in you and a lot of knowledge/experience that you just cant ignore... look into becoming an instructor... get for former OIC/s , CO's and all your Evals along with your Training and field duty ribbons ext and build a case.. you can cross ref. others in your field that have done/continue to do an outstanding job in the civilian sector... i believe that one of the civilian heroes of 911 was former military check into this along with other officers that are now your age and their proficiency... build your case... again on the dollar approach not the human factor... Gov moves on $ before moral issues. go for it

Alot of jobs in law enforcement have maximum age requirements just as alot of jobs have minimum age requirements. Doesnt certain branches of the military have maximum age requirements? I know they used to.

YOU CAN JOIN THE POLICE AT THE V.A. HOSPITAL.
I KNOW 38 AINT TOO OLD FOR THAT DUTY AND THAT CONTINUES TOWARDS YOUR RETIREMENT. THATS A FEDERAL JOB.
AS FAR AS DISCIMINATION, YOU SHOULD CHECK ON THAT.
THEY SHOULD BE MORE INTERESTED IN YOUR EXPERIENCE THAN YOUR AGE, ANYWAY.
PEACE OUT
GOOD LUCK

I would check what ACLU has to say on the legality. They are sharp about Constitutional law.

You get time reduced for military service, they are lying to you. Been there, did that.
