Is there a form I can fill out in order to prevent my childs father from illegally claiming my child on his taxes?? My child hasnt seen him in almost one year.... child support payments are jokes.... 11 dollar checks and what not...
any advice??

We were never married, and i have physical custody of my child. There is no provision in the support order about the taxes, and medical insurance, but I have the insurance, not him.

There's nothing you can file to prevent him from claiming her. But if he does (I'm assuming that you will too) you'll both be asked to show proof that you're the one who is eligible - you'll win that hands down, then he'll be ordered to repay whatever he saved in taxes by claiming the child since she lives with you and not him and there's no court order saying he can claim her. It doesn't matter who files their return first.

well my daughter beat her soon to be x to have her income taxes filed, did a rapid refund and got the credit. He also claimed my grandaughter and the irs did not catch it at first, and 4 months later he got a letter asking for payback as she had already been claimed. It is a game you will have to play until you can get a divorce( that is if you are married) If you have gone thru the system to get child support, and he is not willingly doing it, then have his wages garnished, they will "nail" his income tax refund for back child support. You need to go to social services or a family law group, many of which are free or discounted to single parents or the one who has physical custody of the child.
Good luck and go get the deadbeat, the child is his responsibility too whether he likes it or not. P.S. if he does not have much contact with the child, make sure he does not talk you into giving you full custody by signing off parental rights, then you get nothing at all, and if he works and has health care benefits and you don't , make sure he picks up the child on his policy.

No form can prevent anyone from breaking the law. If you have legal custody, and it sounds like you do, you are entitled to claim your child unless you have agreed in writing to allow him to claim the child. You could file a Form 3949-A. This is used to report suspected tax fraud. This won't prevent him from claiming the child, but it will cause the IRS to examine his return more closely.

If you were married, the divorce decree should say who claims the kid on taxes. He does need the childs social security number to be able to claim the kid.

If you are not legally able to claim your child & he is, he can file a fraud claim with the IRS against you for the taxes you received.

Check your child support order. It should say who claims your kid.

There is a form called a multiple support agreement that each party would sign stating who gets the exemption.

There is no form to prevent him form filing. After he files you can report the fraud to the IRS.

Call the IRS. There is a form for this they send you. Make sure you have documentation because you will have to prove it.
