i need to know if my mother can file hoh. she is single with my sister still living at home, but my sister worked for about 2 months, she didnt make much, prolly no more than 2500.00, but is it legal for mom to file hoh if my sister has to file her own taxes?

Under the circumstances you list, sounds like your mother could claim your sister as a dependent. Assuming your mother provided more than half the cost of keeping up a home, she could also file as head of household. This is whether or not your sister files her own taxes.

If your sister made the amount you mention, she should file, and answer "yes" to "can you be claimed as a dependent". She'll get back any money that was withheld, but must file if she made over $600 and can be claimed as a dependent.

Yes, she can file Head of Household

Dependants are:

1) are the taxpayers child, step child, foster child, brother,
sister, step brother or stepsister or descendent or any of
them.
2) live in your home more than half a year
3) do not provide more than half their own support
4) under the age of 19 or under the age of 24 and a student or
totally disabled.

You will also want to make sure that they mark that they can be claimed as a dependant and that they do not take a personal exemption on their taxes.

as far as I knew anyone can claim hoh. Its just a filing status. Just like claiming single if your married. Just means uncle sam gets more of your money. Is your sis filing taxes on the wages she made????? She would be wise to talk to a professional before going ahead and doing that.

Your mother is obviously providing over half of your sisters support. If she is under 24 and a full time student, your mother can still claim her. And if she is providing over half the household support, she can qualify as Head of Household if she is claiming your sister.

both can file head of house (if sister is over 18 yrs old) - but if they do they can not file the other as a dependent
