What are yuor rights as a victim of a bounced check?

The banks have to send you a letter stating that a check has bounced and the amount of the bounce check fee. You can contact the bank and plead that you made an arithmatic mistake and you may be able to get the bank to wave the fee, but that is about it. Don't say that you wrote the check knowing you had no money in the bank because KNOWINGLY writing a check your account can't cash is a Felony...especially since banks are protected under federal and banking laws.

Unless you can clearly prove that the bank made an error in your account (such as you depositing money and the bank never credited your account or put it in someone else's account in error), you're not a "victim" of a bounced check...the person you paid is the victim of the bounced check and to a smaller extent the BANK is a victim of a bounced check.

They also send you a monthly statement and give you a book with the checks to keep a balance of your account. It isn't the bank's responsibility to balance your account, it's YOURS!

As far as your rights are concerned, you have the right to repay the person who wasn't able to cash your check, the right to pay the fee if your bank won't waive it and the right balance your checkbook and figure out where you made the mistake.

Sorry if my comment seems kind of harsh, but it's the straight up honest truth. You made a mistake, but you're not a victim.

They do notify you.

It appears on your online banking transaction as a $3 or $5 fee.
They send you a letter.

If you have overdraft fees due to a bad check that someone gave you, they need to fix that for you.

They are suposed to notify you, the rights you have are to go after the person who wrote the check insist they pay all your bank charges if they are not willing you might have to go th small claims court to get your money

they always notify you if a check bounced - your rights are that you have can collect on the check and charge the person court costs, bounce fee, atty fees etc. to collect it
