My brother is 21 and his girlfriend is 17 they live in IL. As of right now they live together with her mom and brothers. If the two of them move out could her mom charge him with statatory rape or not considering she allows them to live together. They want to move out because her mom makes her do all the cleaning and makes the both of them give her their checks on payday while she sits on does nothing (she doesn't have a job). So my question is can they move out without any legal percussions. (Age of consent in IL is 17)

She doesnt want to wait until she is 18 because my brother and her never have any money because the mom takes it all and the mom treats the girl like crap. She goes to school, works and then her mom expects her to cook dinner, do dishes, wash the laundry, make sure her brothers do their homework, etc. It just isn't fair to her.

She can't do anything if the age of consent in IL is 17.

I think in this case, statutory rape would be a difficult charge to make stick. Generally speaking, (though your state may differ) this can be charged if the child is under 12, and different charges apply if the child is 13-16-- and also these charges may only apply if a person of authority is involved (teacher, minister, principal). At age 17 and if they're living with the mother, I doubt it'll fly.

Yes i believe they can. As long as the daughter is at or above the age of consent. So i would tell your brother not to worry about it. If she is forcing them to give her their paychecks i would get out and fast, and if the wanted to they could have legal issues with her mother. But no i don't think she could do anything about them moving out!

I think the her mother isn't do a good job period. First of all to let her daughter have a man in the house is ridiculous and she sounds so lazy that I doubt she would even make the effort to press charges on your brother.

They should wait until she turns eighteen to move out. Then there is no problem
