In Connecticut, refusal to submit to a breath test after being arrested results in an automatic 180-day suspension of your Driver's License (or driving priveleges in CT if you have an out-of-state license). These are administrative sanctions by the Department of Motor Vehicles and separate from criminal proceedings.

You can refuse, but if your dealings with the police at that time have gotten to the point where they want you to give a breath test they know you are past the legal limit and are going to arrest you anyway. So they know they are going to take you to holding and have a blood draw taken. Don't get me wrong, simply because you refuse to do a breath test doesn't mean they are going to drop it. In cases where a sample is needed you are either going to do the breath test or give blood at the jail. Yes you will lose your license. They aren't going to hold you in jail for not agreeing to the breath test. They are going to arrest you and put you in jail for being over the legal limit and driving drunk!

You will lose your license for 1 year under the implied consent law (California). You can still be charged and convicted for DUI depending on how good the cop is when testifying even without a breath/urine or blood test.
Penalties differ depending on the judge and the state.
Refusal to take the test is NOT an admission of guilt.

It may depend on what state you are in but in Virginia..if you refuse a breathalizer test then you are automatically arrested for DUI and could face jail time and fines.
I would also consider AA if you have a problem because you shouldn't be driving drunk! If you have enough sense to refuse a breathalizer then you are certainly capable of calling a taxi, friend, walking whatever it takes to make sure that you are not endangering innocent peoples lives.

Wisdom and discretion is in NOT going against any law enforcement agency. Of course, your conscience is the best judge. Also, quite a lot depends, on your social standing, i.e., how your government rates you, or grants you some special immunities / privileges, by virtue of your position, as applicable.
In my country, a citizen is legally obliged to undertake the test, when "authorized law agency personnel," such as the authentic police personnel, on duty, demand such test, as you mention.

In Florida, the law says that if you refuse a breath test, that the courts can take your license away for up to a year with out proof that you were intoxicated. When you get your driving license you agree that you can be tested for being intoxicated.

Don't know where you live, but in Alaska, refusing to take a Breathalyzer is illegal. Not sure what the penalty is, but I do know it's illegal here. And if you were under the influence AND refused the test, you have a very good chance of losing your license.

To add to the poster who said they can take your blood....they surely can. I think, if I recall correctly, they get a warrant for the blood and haul you right off to the hospital to get it.
NOT FUN. I've seen it happen many times.
Take the PBT. You will be MUCH better off in the long run.

When you accepted your driver's license, you agreed to provide samples for a breath/blood test. If you do not supply the samples, you license can be suspended pending your trial date.

it's too late now, but they can hold you until you give them a breath test. so if you were over the limit, you would probably get out of jail sooner if you just did the test.
