more than likely probation....depending on the circumstances. What exactly was done?

Girl, I can't believe that you are worrying about this. I answered your first question when this had just happened. I have no sympathy for people that are in your position. It saddens me that another woman would try to get her "spouse" out of this mess. He did it and you should just leave it alone. I didn't include something in my answer to your first question....so here goes: I had 2 friends...one is dead now. She and her husband got into an arguement and he beat her and kicked her to death infront of their little girl. The coroner's office said that she suffered and did not die right away. It is sad because their daughter is now with out a mother and a father (locked up for life). You see this wasn't the first time that he had hit her. She did the same thing that you wanted to do...you know drop the charges. About a year later another friend of mine was running and yelling down our alley behind our house at 2am. I heard this through my bedroom window. I had no idea it was my friend. Then there was a pounding at our door. It was my friend, beaten so badly that I could barely recognize her. She was bloody and her face was all swollen and to top it off she was 7 1/2 months pregnant. Her husband had beat her before but she always dropped the charges. He kicked her in her stomach so she could lose the baby and kicked her in her face with steel toe boots. I had EMS, police, highway patrol, and sheriff's deputy's in my home. You see her husband told her that he was going to end up killing her like "Shaun" killed "Mel". Now, if you want to end up like my friend then by all means go stand by your man and instead of being a wife you will just be a punching bag. You allow someone to get away with it once it will happen again. I can promise you that. My dad always promised my mother that he would never do it again and she made sure it wouldn't she divorced him.

There are too many variables to answer question correctly. Agg. Assault means different things in different states. It can be a felony or a misdemeanor. In some areas, if there is an Agg. Assault during a Domestic Battery, it means mandatory jail time. You have to check with your local DA, or check the revised statutes for you state.

There could be jail time. From what I have heard in Calif. Domestic violence carries mandatory jail time plus abuse classes and also fines. The aggravated assault charge could also get you jail time, even if it is the first time, the probation would be after you got out of jail.

But the best I can say is check with an attorney.

Probably probation for 1-5 yrs, but since it was agg, assault could get a shot jail time also.

You can see jail time for that agg. assault. I was convicted of Dom. Violence and only had to serve 3 days with 4 months of probation and dom. violence classes. The only way you can violate your probation is if you fail to appear to your classes.

Sometimes if you got a clean record then they will let you off. So you should have a 50% chance that you will not get jail time. But it is depending on what you did.

If it is that someone hit you and your trying to drop the charges DON'T DO IT!!!! Trust me I was in a relationship with a man that beat me and I did drop the charges because he said he was sorry and he loved me oh and let's not forget the "if you would have just left me alone I never would have"!!! It's all bullcr@p!!! He Will Do It again!!! Don't protect the loser get your butt out of there while you still can!!!!!!!! Please!

There can be jail time if you press charges and the judge want to teach a lesson or it could be a slap on the wrist. Hard to tell, you would have to speak to the DA to get his/her feedback.

Please, please take Cynthia's advice...She has told it like it is, for alot more women than anyone of us realize. Don't put yourself in the position of being assaulted over and over...it's a vicious cycle...
