when would it right according to islam, to get back all your rights from a father who made the life of his son miserable and never was responsible for his kid. Not only that, he never paid a penny in order to make him happy (altho he has enough money), he only paid for himself, i.e he is selfish and never cared to please his family, he even fought with everyone who lived in the neighborhood, forcing everyone not to come near his family or get to know them, this family is the most miserable family on earth becoz of that man, this family thinks that their life would be much better if they took their rights back from this so called father.
so what's the proper solution for this family's problem according to Islam??

The child must always respect the parent for the gift of life! Even if the parents are wrong, for there is still a life lesson in there that no one else could ever teach. I worked with a Muslim man, and he told me only that, that you must always respect your parents, even if you know that they are wrong. It is simple, yet profound, and he was right. The gift of life is priceless, and it up to the son to do with it the best he can. Dwelling on material injustice is not befitting on someone who has a soul.

If the father does anything against the Quran or Hadith then the children are allowed to do what is in the Quran and Hadith.

However the situation you have stated would need to be disscused with a lawyer (from the Hadith and Quran). This special type of lawyer can deal with the situation the best.

this only can be done in a court that is based on shariah law.we can not take a muslim to court and sue them in this manner.there is a hadith and an ayat where it is sad that do not take jews and christians as your protectors and friends.it would benefit you to read the tafsir on that ayat so u can know the full meaning of it.and dont forget allah(Swt) said that he is test us with our family,children and money.
