I was driving when a man coming the opposite direction mad a left hand turn into a a construction driveway.I was about 300 ft away from this man He made the turn no problem, then as soon as my car became perpendicular to the rear end of his truck he slammed it in reverse and completly bashed in side of my car forcing me onto a divider. Cop said he had already backed out then I ran into him, but I have no front end damage to my car, being my fault. What do I do???? HELP!!!!

Unfortunately, most cops are report takers and not accident investigators. Few have little if any training in determining fault, or even what to look for. Try talking with the officer's supervisor and explaining the situation to them. Take photos of your vehicle, the scene and if you can the other guys truck. An insurance company (yours or his) probably won't fight this too hard. They may consider it a no fault crash and your insurance (hopefully) will cover your vehicle. Speak with your agent before making any decision. Good luck.

I would write my own statement of what happened and take it to the police station and ask that it be included with the officer's report. Then, report the crash to your insurance company, making sure you have the other driver's information. If the other guy makes a claim against you, your insurance company will contact you. Instruct your company to deny the claim. You will probably then have to record a statement over the phone to your company detailing what happened.

The insurance companies can get the incident report from the police; you don't need to pay the fee.

Six years ago a neighbor of mine cut the corner too close when leaving his parking space in our parking lot and roughed up the passenger door pretty bad on his truck. He called the police to report that I must have backed into his truck. Let me tell you, I would have to have been one very bad and disoriented driver to do such a thing (we both backed into our spaces).

The officer didn't believe me and bought the neighbor's story. Later that night, I noticed that the front left corner of my bumper was scraped pretty bad. I took photos and measurements and found that the marks lined up, even though the police officer said I had paint transfer on my rear bumper (I didn't). The officer never returned a message I left.

Anyway, the guy tried to put a claim in against me and I told my insurance company to deny it. I recorded my statement on the phone. That was that. The guy didn't pursue the matter. I wonder why...

It boggles my mind how someone could be so dishonest. (Of course, he had a "beautiful" new truck and I had a deteriorating Ford Escort.)

If u hav no front end damage and if you have pictures taken either by yourself or the by the police, then u can obviously prove that what the cop is reporting to be false. Cause obviously if u had hit him there would be front end damage to your vehicle. Get a copy of the "Official" Police report made by the officer and go from there. If you can not rectify this by the time that u report it to your states dmv, then u need to place what happened on that report and have them look it all over with your report, the other drivers report and the police report. If anything happens to the contrary then u need to contact an attorney.

Another option is to have the police dept. accident reconstruction team to look at it or request that another agencies look at it.

well start by getting a police report you will be able to find some errors in the report. then dispute them with the officers boss. use facts when making your argument and ask that the report be changed. if you got a fine take your facts into court. you have nothing to lose. you can also get an attorney to write a letter. it accutaly doesnt cost that much. oh ya and your insurance compay will give you an attorney to fight for your point because they dont want to pay if you are not responsible. they will become your strongest advocate. take pictures of every thing you can

Immediately call your insurance company and explain what happened and the officers attitude. I suspect that you are fairly young and the other driver was older. Unfortunately, all too often it is assumed that the younger person was at fault. Your insurance company should fight the claim for you. Be sure to take pictures of the scene of the accident and your car also.

take pictures go to the hospital and steal a neck brace &sue....don't worry what the cop says he was not there only crime accident investigators and insurance adjusters-not all-have a good sense of the truth...remember #1if he commited himself to that spot before you arrived it's his fault for not yielding right of way to begin with remember he pulled out into the flow of trafficand bumped you into the median ....#2. if he pulled out into you that's the same as backing up from a parking space in to someone that's drivng by you at the grocery store right,again not looking & failure to yield right of way#3 call your insurance company & explain how much your neck hurts and could it be that bad since it wasn't a head on collision see whattheir attorney says...#4 tell that to his insurance claims attorney can you say the words "settle,settle settle" you're looking at big bucks with an injury so please get it checked, hopefully if not hurt,you're looking at a new car at his expense goodluck!!! we are here to help

something similar like this happened to me. Once the police write the report that is usually the last word. It sucks, but if no one was hurt, and you have insurance, its not worth fighting the police in court cost etc.
As much as your burned its better just to pay your decutable and move on.
You could go to the police station get a copy of the report take it to your insurance they may investagte at no cost to you.

first call your insurance company tell them the truth the whole truth, and if you dont have a good insurance company then get a lawyer and fight this cops are jerks they dont care what happend they are just looking to make it easier for them. he didn't want a fight with the guy so he gave you the ticket because what are you gonna do about it? cry? my insurance company is sueing the guy who hit me and after they win that they are going after the cop who gave me the ticket, best of luck to you

Get a lawyer, be sure you have pictures of both vehicles & the location of the accident, and statements from witnesses if available. Don't worry, things will get worked out!
