It was the other guy's fault, I was stopped when he slammed into me. My baby was in the car in his rear facing car seat. What are the requirements for replacing the car seat?

They may not be legally required to replace it, depending on where you are. Have a certified child passenger safety technician inspect the seat. Your local police/sheriff/state patrol should have someone who is qualified to inspect and install the seat. If there are ANY outward signs of damage on the seat, replace it immediately do not wait on the insurance.

Yes, they will pay for the car seat. Studies actually show that a car seat involved in an accident is unstable afterwards, even if it doesn't show damage.

If you bought it recently, see if you still have the receipt. Otherwise, go online and find one as similiar as possible for sale. The insurance company will pay to replace it, minus some depreciation if it is older than a year or two.

Hold on the car seat in case the insurance company asks for it. They are entitled to it if they pay you to replace it. Most companies don't ask, but occasionally they will. Once you get a new car seat, write in marker on it that it was in accident and throw it out.

I had the exact thing happen to me a couple of years ago.I had trouble with my own insurance company, they didn't want to pay. I contacted the insurance company of the driver who hit me (it's on the police report and the police can tell you what company it is if it's in code). They told me to buy a new car seat and send them a copy of the receipt. About two weeks later I got a check.

It is very important to replace the car seat after an accident!

Yes, I am sure his insurance company would gladly pick up that cost. Just ask them.
