I'm so sorry you are going through this. First, if you suspect abuse, you need to contact child protective services. I suggest that you first call 1800-4-A-CHILD. This is a free hotline that will provide you with guidance and assist you with reporting the abuse. They should also be able to assist you with finding free legal services.
Even if child protective services does not determine abuse after conducting an 'investigation', the child is obviously emotionally disturbed, which means the mother and/or CPS are responsible for making sure that the child receives appropriate mental health care. Also, even if abuse is not determined initially through CPS, a discovery of abuse may come out when the child goes to counseling. At this point, CPS will determine if the child needs to be removed from the home, but remember, the goal of CPS is reunification of the child with its biological family.

Please go to the Family Courts and ask for Legal Aid This a free program. Explain your situation to them, They will send someone to investigate his home life, and give him a psychological exam for his suicidal thaughts. If they find that his parents are not fit to raise him ,he will be taken out of the home, Than and only than can you go for Custody, Make sure there are not any skeletons in your closet, because they will search your past records and life style. It helps when the child wants to be with you , but it has to be a good reason to take the child from his Mother...

first off call and talk to a D.C.F.S (department of children and family services) representative.Explain to them the issue and they will investigate.Tell them that you are willing to be the child's legal guardian and that you have been trying to care for him but have gotten no help from the people you have tried to speak with.
To start he will go into their custody but allow you to visit him if after checking you out they see you as fit for him to be associated with.(your past and current record and way you live).They go through their channels but in the end they would rather see kids end up with someone in the family or at least close to the kid that the kid knows and likes being with as long as the said person is financially and mentally stable and suitable.
I don't know their numbers but If you call information and ask for them in your area I am sure they can get you the right number and locations for them.

First of all you will need to have proof. I agree with the first answer report it to child protective services so they can start the investigation process as soon as possible. Then after the process has started maybe you can at least get guardianship of the child.

wont give up custody and with ABUSE??!?!?!?! police may be needed. actually they should be involved since the only reason is that shell lose her benefits. thats !$%#^@& ridiculous. im sory but that realy pisses me off to think that someones parents are abusing their child and wont give him up cuz theyr afraid of losing benefits. u should phone her up and threaten her with the POLICE dragging her son to you, and u getting custody. and if she doesnt give in, phone the police, and get them to talk to the 5 year old son whats been going on. ( phone child services as well) im sorry i cant help, honestly, good luck, to both you and hopefully ur soon to be adopted godson.

I Understand this situation, I used to be in your godson's position on this one.... My advice is to contact a family practice Lawyer, They might be able to get him out of that situation, and Maybe they can work out a settlement for the Gov Benefits situation. I'm with you on this one, GET HIM OUT OF THERE!!!

talk to child pretection services... have him speak witht hem and tell hthem what happens at home.... go to a lawyer... do all u can that child desearves a much better life than what hes getting and u seem as though u can give it to him... good luck wit the process it may take a while but i think u will get jst wat u want!

Call Social Services in your area..If abuse is determined, they will take him away, regardless of her ranting!!!!!
In our state, NH, it is the LAW to report any suspected child abuse. Call the police first if you have to.
