A tomato is by definition a fruit but is more popularly known as a vegetable.
According to Wikipedia:
"In botany, a fruit is the ripened ovary—together with seeds—of a flowering plant." ... "when discussing fruit as food, the term usually refers to just those plant fruits that are sweet and fleshy."
"Vegetable is a culinary term. Its definition has no scientific value and is somewhat arbitrary and subjective."
There was actually a ruling in the US Supreme Court on May 10,1893 that officially classified the tomato as a vegetable.

Most people assume that it is a vegetable because it looks like one and it does not taste sweet like other fruits do. The answer is a fruit. The reason why is because it has seeds.

Actually there is no technical definition of vegetable. Only a subjective one. There is a technical definition of fruit in the field of botany: the ripened ovary and seeds of a plant. Nuts and grains are also technically fruit. So according to botanists tomato is a fruit.
