They collared him a few years ago, but what happens is that because people want him in their homes, even going so far as to leave him milk and cookies, then the man's got right and privelege to be there so its like you letting in the cable guy when you're not home. (that is if you trust him enough) But if you find anything missing on Christmas morning, You can certainly pursue charges and a restraining order.

Because if those other fat old white guys wearing red could fit down chimneys, not get stuck, or dirty, and leaves presents- they wouldn't get arrested either.

There is no forced entry going down the chimney and he does not steal. He could be trespassing, but most people invite him in, even going so far as to send letters asking him to come.
He is a guest. His presence is, thus, not illegal.

He doesn't take anything, he leaves stuff. He kind of takes milk and cookies, but you leave them out for him, I mean who the hell would leave out a plate of milk and cookies in the middle of the living room over night? Honestly.
