I was referred to occupational health because I returned to work early after a short absence. The Dr said I am unfit but my boss says I can continue to work because I want to, do my job and am ok, is this legal?

no it is not legal if something happens to you or other around you because of you then thats where the problem comes in at

Depending on the seriousness of your problem. They are just doing their job to help you recover quicker. If you wish to continue working go ahead but beware on possible future complications that might occur. Discuss it properly with your occupational pherapist and state why you need or want to work again. Remember they treat you. It is your decision at the end.

I've found that if I work part time that it helps because, I don't feel so stressed out. I'm hoping to return to work after I fell down the steps of streetcar and dislocated my left shoulder, ouch! Well they say only we know if we're ready to return to work after we've had a bit of a break. As for the legal side it's hard to know.

legally if you are of sound mind you can make the decision to work, however your boss is not responsible for any injuries you incur because a doctor said you were unfit.

yes i went back to work when my doc said to take more time off but i don`t think it is illegal or anything like that, and i`m sure if it was your boss would tell you as he could get into trouble for letting you work while your on the sick, hope that helps you x

unless you have some highley contagious desiese, or you are a risk to health and saftey in your work place then it is fine for you to work, although you should always take the advice of your doctors very seriously they dont warn people off not going to work for no reason.

you can but if something happens you will be liable not the boss as you are the one who decided to go against your doctors advice.
if i were you i would go by the doc because you may make you problem worse or reoccur and you benefits may be affected

It depends on the situation. Why dont you seek another opinion?So long as you are not at risk of hurting other people or yourself Idont see why not.

Since your doctor hasn't formally released you to work, you really shouldn't go against his advice.
