When cruising at 70mph for a while it will jump out of gear and not go back into gear until speed drops to about 40mph, i have checked the oil level and that is ok so i would love to hear from someone who could give me an idea of what it could be.
thanks Ade

Your flywheel might need to be replacing.

I believe that some components in the gearbox need to be replaced, like drive gears, syncromesh gears and maybe bearings. Not necessarily replace all of them, just the worn out ones. If there are many components to be replaced, I suggest that you get a quote for the required parts and also consider replacing the complete gearbox with a good second hand one. Check and decide what's best.

Ade your torque converter clutch plates are in need of changing before they start to slip so bad they wont give any gear .That is costly and damage at 70mph is a nasty expreience avoid high speed till fixed did you use correct grade of gear oil that can make a difference also .Not going back in to gear i suspect the clutches good luck

The problem is in the Question- it's a Mondeo. (lol)
if the car goes into the other gears ok, it may be a ECU problem.
(The computer is not recognising your speed)

does the Auto- box drop down to 4th or does it go back to neutral?

if the oil has gone black, the clutch plates in the box are worn or the clutch drums, are worn get someone to road test the car also get the wireing to the box checked, also you may have a solinoid sticking.

CD4E box has not been as successful as Ford would have liked. It may be a mechanical problem within the box, ot there may be a box ECU problem. I think you will have to have an auto box specialist, or your Ford dealer analyse it.

I can't understand why you would have a problem with that. It's one of the better ones made in Korea.
