How long has it taken someone in this situation to get Permanent residency: A born US citizen that is legally married to an undocumented immigrant for 3 1/2 years.

It can take as little as 6 months. That's how long it took for my wife.

By undocumented, do you mean entered the US without inspection or entered on a valid visa but has overstayed?

If its just a matter of an overstay, depending on how much out of status time has accumulated, you would most likely need to file a waiver for the overstay, which would delay any petiton for permanent residency by a year or more.

If its a matter of entering the US without inspection, then I'm not sure what you would do except hire an experienced immigration lawyer.

Section 221(g) of the Immigration and Nationality Act reads:
Sec. 212. [8 U.S.C. 1182]
(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

(i) In general.-An alien present in the United States without being admitted or paroled, or who arrives in the United States at any time or place other than as designated by the Attorney General, is inadmissible.

Well, I am a US Citizen who has been married to a Chinese national for five years. For almost three years we have been trying to just get a visa, so we can go to the US as a family.

I'm willing to bet an illegal immigrant in America would be able to get permanent residency faster than my wife can even get in to America. Crime pays!

I'm not sure how long it takes them to become a legal citizen, but I know that once you marry someone who is an immigrant, you are obligated to care for them for I think ten years regardless if you get divorced or not.

It takes about a year, and it´s called Form I-130, Petition for Alien Relative. All the information regarding this is on the website www.uscis.gov. You might run into problems with him being undocumented though.

I think it's 1 year, but I heared it changed to five years. I had a friend ( I didn't approve of this, but it's not my life) who married her boyfriends best friend, ( on the request of her boyfriend) yes, wedlock, married forever and ever kinda deal.

She married him because his visa expired, and he didn't want to go back. I don't know what the outcome was, I stoped talking to her after that, she was only 20.
