My fiancee kissed a a girl when he turned 18 who was 15. She said he gave her an std but this isnt true. I would have one. Her mom wants to put him in jail. Thats 5-8 years. Can he go to jail and anyone have any advice.

So it seems there was a little more to it than just a kiss, huh? The activities that you described would certainly fall under:
Sodomy in the second degree.
(a) A person commits the crime of sodomy in the second degree if:
(1)He, being 16 years old or older, engages in deviate sexual intercourse with another person less than 16 and more than 12 years old.
The definition of ‘deviate sexual intercourse’ is: "Any act of sexual gratification between persons not married to each other involving the sex organs of one person and the mouth or anus of another."
Sodomy in the second degree is a class B felony for which the sentence is "not more than 20 years or less than 2 years".
Do they have enough evidence to go to trail and get a conviction…who knows? Boyfriend needs to talk to an attorney.

Yes he can, the act is called sodomy. Any sexual act with a minor is an offense, but the punishment is different in each jurisdiction. As far as her word against hers, too many dirt bags have gotten off by using that idea... current ways of thinking would give her the benefit of the doubt (same way as acquaitance rape became a crime). If there is proof in any form (DNA OR A TRANSMITTION OF A DISEASE) then he is through.

yes my brother went to jail for 5 years when he was 17 he girlfriend said she was 16 she was really 14 and after 6 months of a relationship it went bad and her and her mom decided he should go to jail and he did and hes back in right now cause he cant find work and they keep putting original charges back on him for breaking parole if he gets convicted say goodbye to him forever when he comes back itll be temporary and you will have to register as a sex offender and all of your neighbors will know it pretty embarassing its sad when it really does happen but sometimes there are story telling kids and those kind of people put good guys behind bars its sad but true you people know what iam talking about not all of your kids are angels

WoW. It seems the only std she couldv'e cought would be herpes simplex virus 1 which in that case he could have without having symptoms and could transfer it to others with out even knowing. He would have to have a blood test to see for a fact if he does have it or not, BUT with that said- he didn't have intercourse with her so its not statutory rape, I wouldn't think theres laws against kissing but then again to be safe I would call your local police department or a local lawyer and ask them specifically if there are any laws in your town or state that would consider what he did to be unlawful. That is the only way you will know for sure. Sorry for your situation.

Depends on the judge.
Techically she's suppose to have reported it immediately. Had a rape kit done and they are supposed to have physical evidence.
If she's under 16 she can't give consent and her word in court can also be contested on the same basis she doesn't know right from wrong.
But in Alabama, who knows.

You can't go to jail for kissing a 15 year old if in fact that is all that occurred.
Really....you're in Alabamy? I thought the age of consent was 14 anyway there.

If the jury believes that they had sex, then yes.
You might not have caught something because he got treated (if he did sleep with her).
Sucky situation if he didn't - my hubby was accused of something similar way back. Luckily girl recanted her story so he was never charged.
Ask for 3 forms of ID's before kissing/sleeping with someone. It pays to be vigiliant.

did she give him a birthday kiss? can you say you were there to see it? can you get people to testify she been around the block a few time's? has he been tested for an std? do he have a decent lawyer? is there more to this than being told? is she wanting to have your boy?

Is there any physical evidence that he kissed her? No. It boils down to her word against his. If kissing is all they did, then there is no case.
