Assuming it's true that he is a child molester, what would be wrong with saying over the mic that "This man (and point the man out) is a CHILD MOLESTER and he molested my brother when my bro was 5 years old! I have the bail money and I will pay all legal fees if anybody in this bar wants to kick his ***!"?

okay I won't say the last sentence because if he gets murdered by a drunk I don't want a conspiracy charge. The molestation happened in 1975 and bro didn't tell my parents till 1980. I ran into this creep at a bar and I called him out in front of his friends. He didn't sue me. Next time it won't be so pretty. His last name is Two-Hatchett in Wichita, Kansas.

You would get slander ONLY if it was not true.

You would get disturbing the peace.

You probably would get some kind of hiring a hit man arrest, which is a felony.

I think you're being a bit naive. On the face of it, there would be a clear case of slander. You say it's TRUE, which might be some defence in a defamation case, but a) how are you going to prove it's true, and b) are you willing to go all the way to court, which could take months and cost loads in fees, to state your defence and hope the court buys it? Also, even if you are correct about this man, the court might take the view that you were malicious in your act of making your statement in public, which would possibly add weight to a charge of slander.
There is also possibly an incitement charge that could be applied to you for encouraging other people to attack the man.
You are asking for trouble, in short.

Unless you can PROVE that he is a child molester and he has a criminal record that you can PROVE he has, you could be sued for slander, libel, and defamation of character. File charges, get a conviction, and THEN you can say he is a child molester. Do NOT say to kick his ***... he could wind up dead, and you could be convicted for conspiracy to commit murder and if what you are saying is true about him, then he sure as "heck" isn't worth going to prison over, and somebody else might do it all on their own. File charges, and take it from there.

I'm not sure if that's breaking the law, but the guy can definately sue you for public defamation.
How about you be civil, report it to the police? If what you claim is found to be true, his name will be part of a database and the public (the entire state) will know. If he's a real danger, his neighbors will be directly told by law enforcement. If it's not true... well then, at least you won't have a lawsuit on your hands.

Why don't you go to the police rather then have a bunch of drunks angry at this person? If he DID do something - or even if he didn't, by bringing accusations about child molestation up with someone, his name will get smeared in the papers and news and not forgotten by a bunch of people in a bar.

Well, for starters, if you're wrong, that's slander, which is a sueable offense. Second, by soliciting someone to physically harm this guy, you'd basically be hiring a hit man, which is also against the law, so you'd better pay the legal fees for whomever kicked the guy's azz and yourself as well. That's why we have cops. If you have the evidence, send it to the authorities. And if you want to hire someone to harm this guy, either do it yourself or make arrangements in private. having that many witnesses to an illegal act is kinda stupid.

Oh, and you'd be a major buzzkill on the whole karoke night, which isn't against the law but should be.

OK, you just set yourself up for a possible slander/libel charge right here. YOU may know he did it, your BROTHER may know he did it, but unless the LAW says he did it, he's not "guilty". Therefore, by putting him name here you run the risk of having him successfully sue you for slander. How would it make you feel to know he not only got away with the crime but now you have to pay him because of it? stop putting his name out in public unless he has been charged and/or convicted. If you want to deal with him, arrange it in private and stop being so public about it. It could end up being YOU who spends time in jail if you don't stop. Seriously.

Do it if I lived in Wichita I would help, but one thing to remember if you are wrong, and I assume you 100% sure, you could open up a whole new can of worms. In fact just by doing it, even if you do not ask people to kick butt you are crossing a line. Good Luck.

Besides this guy probably doing some serious damage to your face if it's not true, he can sue you for defimation of character. Unless you can FULLY prove he did it, don't say anything like that in front of people.
Go to the police if you feel you want to make a report about it.

Hmmmm...slander and libel for one. Forget the fact you can be arrested for breach of peace or maybe inciting a riot.
The civil ramification would send you to the poor house. So you'd best be careful and look before you leap.

Wait until people have been drinking for a bit and you won't need to add the last sentence (no "hitman" charge that way).

And would that change the past? Would it help your brother? Adding more wrong to wrong does not solve a problem. Why not go to the police and open a case against the man.
